These terms govern your use of the Fixby mobile application ("the App") and the website at fixby.app ("the Website"). By using Fixby, you agree to these terms.

1. Service description

Fixby is an AI-powered assistant that helps you understand and maintain your home appliances. It reads your appliance manuals and provides answers, maintenance schedules, and guided repair instructions based on their content.

2. Important safety disclaimer

• Always follow manufacturer safety warnings. Fixby surfaces safety warnings from your manual, but you are responsible for reading and following all safety instructions.
• Dangerous repairs require professionals. Fixby will recommend contacting a qualified technician for repairs involving gas lines, high-voltage components, refrigerant systems, structural modifications, or other hazardous procedures.
• You assume responsibility. By following any repair guidance in the app, you accept full responsibility for your safety and any consequences. Fixby and its operators are not liable for injury, property damage, or appliance damage resulting from actions taken based on app guidance.
• When in doubt, call a pro. If you are unsure about any step, stop and contact a qualified repair technician.

3. User accounts

You may create an account using Sign in with Apple or Google Sign-In. You are responsible for maintaining the security of your account. You must be at least 13 years old to use Fixby.

4. User-uploaded content

Fixby does not host, distribute, or maintain a library of appliance manuals. We only process manuals that you upload yourself.

When you upload an appliance manual to Fixby:

• You represent and warrant that you have the legal right or explicit permission to upload and process that manual (e.g., you own the appliance, or you have lawfully obtained the manual)
• You grant Fixby a limited license to process the manual for the purpose of providing the service to you
• You agree to indemnify and hold harmless Fixby and its operators from any claims, damages, or liabilities (including reasonable legal fees) arising from a breach of this warranty or from content you upload
• The original PDF is retained only for as long as needed to provide the service to you (see our Privacy Policy for details)

5. Archiving and automatic deletion

Fixby allows you to archive appliances you no longer actively use. Archiving an appliance starts a 7-day grace period:

• 7-day countdown. Once archived, the appliance and its associated manual are scheduled for permanent deletion after 7 days.
• Unarchive to cancel. You can unarchive an appliance at any time during the 7-day window, which cancels the scheduled deletion and restores full access.
• Re-archiving restarts the timer. If you archive the appliance again after unarchiving, the 7-day countdown begins fresh.
• Deletion is permanent. After 7 days, the appliance record, its uploaded manual PDF, and all associated data are permanently deleted from our servers. This action cannot be undone and the data cannot be recovered.
• On-device data. Local data (chat history, cached bundle) is removed when the appliance is deleted. The on-device AI model is not affected.

Archiving or deleting an appliance does not restore the appliance slot. Each slot represents a one-time setup fee for processing your appliance manual.

6. Copyright complaints (DMCA)

Fixby respects the intellectual property rights of others. If you believe content processed through Fixby infringes your copyright, send a written notice to our designated agent at support@fixby.app including:

• Identification of the copyrighted work claimed to be infringed
• Identification of the material you claim is infringing, with enough detail for us to locate it
• Your contact information (name, address, phone, email)
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the notice is accurate and you are authorized to act on the copyright owner's behalf
• Your physical or electronic signature

We will respond to valid notices in accordance with applicable law, which may include removing or disabling access to the identified content and terminating repeat infringers' accounts.

7. In-app purchases

Your first appliance is free. Additional appliances require a one-time in-app purchase. Purchases are processed by the Apple App Store or Google Play Store and are subject to their respective terms and refund policies.

• Purchases are non-transferable between platforms (iOS and Android)
• Refund requests should be directed to Apple or Google, per their refund policies
• Fixby does not offer subscriptions — all purchases are one-time

8. Acceptable use

You agree not to:

• Use Fixby for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract the AI model or processing pipeline
• Upload content that infringes third-party intellectual property rights
• Attempt to access other users' data or accounts
• Use automated systems to access the service in a manner that exceeds reasonable use

9. Intellectual property

Fixby, including its design, code, AI models, and branding, is the property of its developers. Appliance manuals remain the property of their respective manufacturers. Fixby does not claim ownership of any manual content.

10. Service availability

We aim to keep Fixby available and reliable, but we do not guarantee uninterrupted service. On-device features (Ask, Care, Fix, Manual) work offline once set up. Cloud features (manual processing, account sync) require an internet connection.

11. Limitation of liability

To the maximum extent permitted by law, Fixby and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, property damage, lost profits, or data loss, arising from your use of the app.

Our total liability for any claim arising from or related to the service shall not exceed the amount you have paid for in-app purchases in the twelve months preceding the claim.

12. Account termination

You may delete your account at any time (see account deletion). We reserve the right to suspend or terminate accounts that violate these terms.

13. Changes to these terms

We may update these terms from time to time. Material changes will be communicated through the app. Continued use after changes constitutes acceptance.

14. Governing law

These terms are governed by the laws of the jurisdiction in which Fixby operates. Any disputes shall be resolved in the courts of that jurisdiction.
